1. Scope and legal framework
These Terms apply when a person uses gabcomputers.co.za, asks GAB Computers for a quotation, supplies equipment for support or repair, buys goods, or completes an electronic transaction through the online shop.
Relevant legislation may include the CPA, ECTA, the Protection of Personal Information Act 4 of 2013 (POPIA), PAIA and other South African law. Where a statutory provision gives a consumer a stronger right than these Terms, the statutory right prevails.
2. Supplier identity and e-commerce disclosures

The Seller Information page publishes the legal seller particulars required for online trading. Checkout remains disabled until the required legal identity, payment, delivery and supplier configuration is complete.
3. Quotations, diagnostics and estimates
Quotations depend on stock, supplier pricing and the information available at the time. Where CPA section 15 applies to repair or maintenance work, GAB will not charge for work without the required authorisation and will not exceed an approved estimate without informing the consumer of the additional estimated charge and obtaining authority to proceed.
If diagnostics reveal additional faults, parts or labour not reasonably identifiable beforehand, GAB may pause work and request approval.
4. Online orders and formation of the transaction
The online shop allows a customer to review products, quantities, delivery information, courier cost and total price, correct mistakes, return to the cart or abandon the transaction before proceeding to PayFast.
Supplier-fed stock can change rapidly. An order acknowledgement confirms receipt of an order request; fulfilment remains subject to verified stock and successful payment. If ordered goods are unavailable and the law requires cancellation/refund, GAB will notify the customer and refund amounts received within the applicable statutory period.
GAB may refuse a fraudulent or unlawful order, an order affected by an obvious feed/pricing error, or an order that cannot lawfully or practically be fulfilled. This does not permit GAB to avoid a valid transaction merely because it is inconvenient.
5. Pricing and product availability
Customer-facing prices are the GAB selling prices for the products shown. Product prices and availability may change as supplier information is updated.
The price presented to the customer at checkout, together with any disclosed courier charge or other unavoidable transaction cost, is the amount used for that order.
GAB does not publish supplier cost prices or confidential commercial arrangements.
6. PayFast payments
Online payments are processed by PayFast. GAB does not intentionally collect or store full card numbers or card security codes. The customer is redirected to PayFast's environment.
A browser return to GAB is not proof of payment. An order is treated as paid only after server-side PayFast notification validation, including signature, merchant, amount and server confirmation checks.
7. Courier delivery
Available delivery method and courier cost are shown before payment. Customers must provide a complete, correct South African delivery address and contact details suitable for courier communication.
Delivery estimates may be affected by supplier, courier, power, telecommunications or other events outside GAB's reasonable control. Statutory delivery rights remain unaffected. Customers should preserve packaging and promptly photograph visible courier damage where reasonably possible.
8. IT support, repair and maintenance services
GAB will perform services with the quality, care and timeliness reasonably expected under applicable law. Work may include diagnostics, disassembly, component replacement, operating-system or software work, configuration, malware removal, backup/recovery or other authorised technical activity.
Customers should disclose known liquid damage, physical damage, previous repair attempts, encryption, device-management controls and other facts likely to affect the work.
Where CPA section 54 applies and a service fails the statutory standard, the consumer retains the applicable right to require remediation or a reasonable refund having regard to the extent of the failure.
9. Product quality and repair warranties
Where CPA sections 55 and 56 apply, qualifying defective, unsafe or failed goods returned within six months after delivery carry the statutory remedies, including the consumer's right to direct repair, replacement or refund as provided by the Act.
Where CPA section 57 applies, new or reconditioned parts installed during repair, together with the labour to install them, carry the statutory three-month warranty or a longer written warranty if one is offered. Manufacturer warranties are additional and do not replace statutory rights.
10. Returns, cancellations and refunds
The detailed Returns & Refunds Policy forms part of these Terms and explains ECTA cooling-off rights, CPA defective-goods rights, special-purpose returns, incorrect deliveries, software exclusions, return costs and refund handling.
Special-order or personalised goods may lawfully have different change-of-mind rules, but no special-order description removes applicable rights concerning defective, unsafe, misdescribed or non-compliant goods.
11. Software and licences
Software remains subject to its publisher licence. GAB will not knowingly install or activate pirated or improperly licensed software. Unsealed computer software and certain activated digital products may fall outside ECTA's ordinary cooling-off right, subject to the exact statutory circumstances.
12. Customer data, backups and repair devices
Customers should keep a current backup before repair or maintenance. GAB will take reasonable care of customer equipment and data, but pre-existing hardware failure, malware, corruption or encryption can make data unrecoverable.
Possession of a device does not give GAB permission to browse unrelated personal files. Access should be limited to what is reasonably necessary for the authorised service. Personal information is handled under the Privacy Policy.
13. Liability and third-party services
Nothing here excludes liability that may not lawfully be excluded. To the extent permitted by law, GAB is not responsible for delay or failure genuinely caused by circumstances beyond its reasonable control, provided reasonable mitigating steps are taken where possible.
Third-party suppliers, couriers, software vendors, hosting providers and payment processors operate under their own systems and terms, but GAB remains responsible for its own statutory obligations.
14. Complaints and dispute resolution
Complaints should first be sent to georgebotten@gabcomputers.co.za or WhatsApp 076 946 4060. Where applicable, an unresolved consumer complaint may be referred to the Consumer Goods and Services Ombud (CGSO), National Consumer Commission, National Consumer Tribunal or another competent forum.
15. General
South African law
These Terms are governed by South African law, subject to mandatory protections applicable to the customer.
Changes
GAB may update these Terms for legal or operational changes. The version presented when an online order is placed applies to that order unless law requires otherwise.
Severability
If part of these Terms is invalid, the remaining provisions continue to apply to the extent lawful.
